अर्द्ध-वेतन अवकाश एवं रूपान्तरित अवकाश (Half Pay Leave and Commuted Leave) – नियम 93
अर्द्ध-वेतन अवकाश एवं रूपान्तरित अवकाशों की देयताः नियम 93(1)(a) के अनुसार राज्य कर्मचारी प्रत्येक पूर्ण वर्ष की सेवा पर 20 दिन का अर्द्ध-वेतन अवकाश पाने का हकदार होगा।
नियम 93(1)(b) के अनुसार उपरोक्त अर्द्ध-वेतन अवकाश चिकित्सा प्रमाण-पत्र तथा निजी कारणों के आधार पर स्वीकृत किया जा सकता है।
नियम 93(2)(i) के अर्न्तगत स्थायी सेवा का राज्य कर्मचारी को देय अर्द्ध-वेतन अवकाशों की आधी संख्या तक रूपान्तरित अवकाश(Commuted Leave) स्वीकृत किया जा सकता है जो उसकी स्वयं की बीमारी के आधार पर देय होगा। इस निमित्त उसे किसी प्राधिकृत चिकित्सक से चिकित्सा प्रमाण-पत्र प्राप्त कर प्रस्तुत करना होगा।
रूपान्तरित अवकाश (Commuted Leave) निम्नलिखित शर्तो के अनुसार स्वीकृत होगाः
(a) जब रूपान्तरित अवकाश (Commuted Leave) स्वीकृत किया जाये तो उसके एवज में दुगुनी संख्या में अर्द्ध-वेतन अवकाश लेखें से कम कर दिये जावे ।
(b) अवकाश मंजूर करने वाला सक्षम प्राधिकारी संतुष्ट हो कि अवकाशों की समाप्ति पर राज्य कर्मचारी के सेवा में लौटने की पूर्ण संभावनाएं है।
नियम 93(2)(ii) के अनुसार यदि ऐसा अवकाश किसी अनुमोदित पाठ्यक्रम के लिये चाहा जावे तथा अवकाश स्वीकृत करने वाला प्राधिकारी ऐसे पाठ्यक्रम/अध्ययन को सार्वजनिक हित में प्रमाणित कर दे तो एक समय में देय अर्द्ध-वेतन अवकाशों में से 180 दिन तक
के अर्द्ध-वेतन अवकाशों को प्राधिकृत चिकित्सक के प्रमाण-पत्र के बिना ऐसे रूपान्तरित अवकाशों में स्वीकृत किया जा सकता है।
नियम 97(3) के अनुसार रूपान्तरित अवकाश पर एक अधिकारी को अवकाश वेतन उपार्जित अवकाश के समान ही देय होता है।
नियम 97(1) (क) के अनुसार कोई अधिकारी अर्द्ध वेतन अवकाश पर हो तो वह अवकाश
वेतन के रूप में उस वेतन के समान अवकाश वेतन प्राप्त करने का अधिकारी है जो वह अवकाश पर प्रस्थान करने से पूर्व के दिन प्राप्त कर रहा था।
नियम 97(2) के अनुसार ₹ 59000 से अधिक अवकाश वेतन प्राप्त नहीं कर सकेगा। यह राशि वित्त विभाग की अधिसूचना क्रमांक:एफ.1(4)एफडी (रूल्स)/ 2017-II दिनांक 30 अक्टूबर 2017 द्वारा दिनांक 1 अक्टूबर 2017 से निर्धारित की गयी है। इससे पूर्व यह राशि ₹ 23000 निर्धारित थी। यह अधिकतम राशि की सीमा निम्न मामलों में लागू नहीं होगी-
1. यदि अवकाश चिकित्सा प्रमाण पत्र के आधार पर लिया हो
2. किसी अध्ययन के अनुमोदित पाठ्यक्रम को पूर्ण करने के लिये अध्ययन अवकाश की शर्तों के अलावा अन्य प्रकार से लिया हो
Rajasthan Service Rule 93 — Admissibility of Half Pay Leave and Commuted Leave:—
(1)(a) A Government servant shall be entitled to half pay leave of 20 days in respect of each completed year of service;
(b) The leave under clause (a) may be granted on medical certificate or on private affairs.
(2) (i) Commuted leave not exceeding half the amount of half pay leave due may be granted on medical certificate of an authorised medical attendant to a permanent Government servant subject to the following conditions:- (a) When commuted leave is granted twice the amount of leave shall be debited to half pay leave due;
(b) That the authority competent to grant leave is satisfied that there is reasonable prospect of the Government servant returning to duty on its expiry. (ii) Half pay leave upto a maximum of 180 days may be allowed to be commuted during the entire service without production of medical certificate where such leave is utilised for an approved course of study certified to be in the public interest by the leave sanctioning authority.
(3) Save in the case of leave preparatory to retirement, leave not due may be granted to a Government servant in permanent employment subject to the following conditions: — (a) The authority competent to grant leave is satisfied that there is reasonable prospect of the Government servant returning to duty on its expiry, (b) the leave not due shall be limited to the half pay leave he is likely to earn thereafter; (c) leave not due during the entire service shall be limited to a maximum of 360 days, out of which not more than 90 days at a time and 180 days in all may be otherwise than on medical certificate of the authorised medical attendant, (d) leave not due shall be debited against the half pay leave the Government servant may earn subsequently.
(4) A temporary Government servant, who has been appointed in accordance with the rules regulating recruitment and conditions of service framed under the proviso to Article 309 of the Constitution of India or where such recruitment rules have not been framed the appointment has been in accordance with orders issued by the Government from time to time prescribing academic qualification, experience etc., shall on completion of three years service be entitled to commuted leave and leave not due under sub-rule (2) and (3) respectively.
(5) No leave salary shall be recovered where a Government servant, who has been granted commuted leave or leave not due under sub-rule (2) or (3) as the case may be, dies or is retired under * “[rule 53] or is retired on invalid pension under *[rule 35 of Rajasthan Civil Services (Pension) Rules 1996]. In all other cases like resignation, voluntary retirement, removal, dismissal etc. the recovery of leave salary shall be made.
